 Relocation

Columbus Family Lawyers Handle Child Relocation Cases

Bartholomew County attorneys advise parents on proposed moves

Parents who live apart while raising the children they share face numerous challenges. Sound custody and visitation arrangements help, but even successful parenting plans usually require modifications when one parent moves to a new area. Indiana has rules to protect parents and young people when relocation is sought. At Thomasson, Guthrie, Schuh-Ogle & Happel, P.C. in Columbus, we advise parents on the necessary legal process when they are looking to complete or challenge a proposed relocation.

Relocation under Indiana law

Generally, Indiana family law requires a parent to file and serve Notice of Intent to Relocate at least 30 days in advance if they plan to move with their child to a different residence. If the move occurs suddenly, the notice must be provided no more than 14 days after learning about the expected relocation. Notice is not required in the following three instances:

  • The child will live closer to the non-relocating parent after the move and remain in the same school
  • The move increases the distance between the parents by fewer than 20 miles and the child remains in the same school
  • The relocation is already addressed by an existing court order

Job transfers, remarriage, educational opportunities, or family support needs may all trigger relocation requests.

Your rights and benefits in relocation plans

Parents considering relocation often have valid and compelling reasons for doing so, such as improved employment opportunities, higher income, better schools, safer housing, or proximity to extended family who can provide childcare and emotional support. A relocating parent has the right to present evidence showing that the move is made in good faith and is not intended to interfere with the other parent’s relationship with the child. At the same time, the non-relocating parent has the right to object to the move and to seek modifications to child custody arrangements if they believe the relocation would negatively impact the child.

Legal risks and consequences of relocation in Columbus Indiana

A parent who moves without providing proper notice or obtaining court approval risks being found in contempt of court. If this occurs, the judge may order a shift in custody terms or impose sanctions.

Even well-intentioned moves can backfire if they appear rushed, poorly planned, or disruptive to the child’s stability. Courts may view unilateral relocation as evidence that a parent is unwilling to support the child’s relationship with the other parent, especially after a bitter divorce.

For the non-relocating parent, failing to file an objection within the required timeframe can sway the court to allow the move without further hearing.

Legal criteria for relocation in Indiana

Indiana law sets specific criteria for courts evaluating relocation requests. The relocating parent must show that the move is made in good faith and for a legitimate reason. The court then considers whether the relocation is in the best interests of the child.

Factors commonly reviewed by the court include:

  • The distance involved and the difficulty of maintaining parenting time
  • The reasons for and against the relocation
  • The child’s age, needs, and adjustment to home, school and community
  • The feasibility of preserving the relationship with the non-relocating parent
  • Any pattern of conduct that promotes or interferes with the child’s relationship with the other parent

Judges in Bartholomew County and elsewhere throughout the state focus on how the move affects the child, rather than the parents’ preferences.
